By creating an account, starting a trial, or using FalconX, you agree to these Terms.

If you do not agree, do not use the Service.

The Service

FalconX is a software platform designed to help contractors and construction professionals design projects from real photos, track pricing in real time, lock scope and approvals, and monitor budgets during construction.

FalconX provides software tools only. We do not provide legal, financial, construction, or professional advice, and we do not guarantee profitability, cost savings, or project outcomes.

Accounts & Access

You must create an account to use FalconX. You agree to provide accurate, complete information and to keep your login credentials secure.

You are responsible for:
All activity under your account
Any actions taken using your credentials

FalconX may suspend or terminate access if we believe an account is being misused, shared, or compromised.

Subscriptions & Billing

FalconX is offered on a subscription basis.
Subscriptions are billed monthly unless otherwise stated.
Subscriptions renew automatically until canceled.
Pricing and plan details are listed on the FalconX website

All payments are processed securely through Stripe

By subscribing, you authorize FalconX to charge your payment method on a recurring basis.

Free Trials

Some plans may include a free trial.
A valid payment method is required to start a trial.
Unless canceled before the trial ends, the subscription converts automatically to a paid plan.

No refunds are issued for unused trial time or partial billing periods.

Cancellations & Refunds

You may cancel your subscription at any time.
Cancellations take effect at the end of the current billing cycle.
No refunds are provided for partial months or unused time

FalconX may suspend or terminate access if payment fails

Confidentiality & Restrictions on Use

FalconX contains confidential and proprietary information, including but not limited to:
Software logic and workflows
Pricing systems and design tools
Product concepts, features, and interfaces
Hardware configurations and integrations

You agree that you will not:

Copy, replicate, or imitate FalconX or any part of the Service
Share screenshots, recordings, workflows, or internal functionality with third parties for competitive purposes
Use FalconX to build or assist in building a competing product
Reverse engineer, decompile, or attempt to extract source code
Publicly disclose non-public features, designs, or system behavior

Any unauthorized use or disclosure may result in immediate termination and legal action.

Acceptable Use

You agree not to:

Use FalconX for unlawful purposes
Share account access with unauthorized users
Upload malicious, misleading, or harmful content
Interfere with system security or performance

FalconX reserves the right to suspend or terminate accounts that violate these rules.

Intellectual Property

All software, designs, trademarks, workflows, interfaces, devices, and content associated with FalconX are the exclusive property of FalconX Technologies Inc.

You are granted a limited, non-exclusive, non-transferable, revocable license to use FalconX only while your subscription is active and in compliance with these Terms.

No ownership rights are transferred to you.

User Data & Privacy

You retain ownership of your project data and content.

FalconX may:

Store and process data to provide the Service.
Use anonymized and aggregated data to improve performance and features.
Use of FalconX is subject to our Privacy Policy.

Peak Plan & Hardware

Certain plans may include FalconX hardware devices.

Devices are provided for use only while an active subscription remains in good standing

FalconX may disable or restrict device functionality if the subscription is canceled or unpaid

Devices are not sold outright unless explicitly stated in writing

Availability & Changes

FalconX is provided “as is” and “as available.”

We do not guarantee uninterrupted service and may modify or discontinue features at any time.

Limitation of Liability

To the maximum extent permitted by law:

FalconX is not liable for indirect, incidental, or consequential damages

Total liability will not exceed the amount paid by you in the previous 12 months

Termination

FalconX may suspend or terminate access if:

Payments fail.
These Terms are violated.
The Service is misused or exploited.

You may stop using FalconX at any time.

Changes to These Terms

We may update these Terms periodically.

If changes are material, users will be notified. Continued use of FalconX constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the jurisdiction in which FalconX Technologies Inc. is incorporated, without regard to conflict of law principles.
